A 42 year old man, John Mbam was on Thursday remanded at the correctional facility by Ebonyi State Magistrate’s Court, sitting in Abakaliki for allegedly defiling a 14-year-old girl, Favour (Surname withheld by us).
The suspect was arraigned on one count of unlawful sexual intercourse with the victim who is said to be resident in the same compound with him.
It was gathered that he sent the minor on an errand, but stopped her from coming out of his room, after delivering the item to him. It was at this point, sources said the suspect forced himself on the little girl.
It was further gathered that the accused person committed the offence at the Ebonyi Voice Avenue, Mile 50, in the Ebonyi Local Government Area of the state, on 28th June, 2020.
ASP Mathias Eze who was the Police Prosecutor told the court that the offence was punishable under 34 (2) of the Child Right Law and Other Related Matters, 2010.
The charge read, “That you John Mbam ‘M’ on 8th day of June 2020, at Ebonyi Voice, Mile 50 Abakaliki, in the Abakaliki Magisterial District did have unlawful carnal knowledge of one Favour (Surname withheld by us) ‘F’ aged 14 years and thereby committed an offence punishable under section 34 (2) Ebonyi Child Right Law and Other Related Matters, 2010.”
The Defense Counsel, M.C. Mgbada, applied to the court that his client be admitted to bail.
But the Prosecuting Counsel, ASP Eze, objected to the application on the grounds that rape was no longer an issue being treated with a wave of hand.
Chief Magistrate, Nnenna Onuoha in her ruling, ordered that the accused person be remanded at the Nigerian Correctional Centre, Abakaliki, while his case file should be forwarded to the Director of Public Prosecutions, for necessary legal advice.
The matter was adjourned till 29th July, 2020 for report of compliance.
